Obama’s Legacy: The Trashing of Free Speech

No administration in memory has more thoroughly undermined freedom of speech and of the press than that of President Obama.  From the White House itself, as well as the independent and executive branch agencies, have come a steady stream of policies, initiatives, and pronunciamentos that have threatened or compromised both of these constitutional rights.

Indeed, the Administration’s example has inspired like-minded actions outside of the White House.  For example, those Democratic members of Congress who actively encouraged IRS action against conservative nonprofit organizations before Lois Lerner turned to the task.

And the 16 state attorneys general, Democrats all, who have recently embarked on a campaign designed to silence people who are skeptical of the evidence of anthropogenic global warming and/or its effects and remediation.

But it’s the example of the Administration itself that is most notable.  Who could forget the performance of then-UN ambassador Susan Rice who, five days after the Benghazi attack that took the life of the American ambassador, went on national TV and blamed the attacks on an anti-Islam video shown on YouTube?

‘Citizens United and Its Critics’

The Yale Law Journal has just published online an article by Floyd Abrams.  In language that is stirring in the power of its logic and elegance, yet solemn as a wake, the famed constitutional lawyer writes of his dismay over the way so many scholars and journalists have treated the Supreme Court’s decision in Citizens United, which largely overturned the law commonly called McCain-Feingold.

Abrams is neither surprised nor disappointed that these critics didn’t like the decision; his despair stems from their failure even to acknowledge the most obvious First Amendment aspects of the case.  They have, he says, treated the ruling “as a desecration.”

Many people will review this article narrowly, in that they will focus their comments, pro and con, on the law and facts of the case at issue.  But I view it from a wider perspective.  I think it’s one of the grandest examples in recent memory of the courage that’s required these days to defend and promote free speech even-handedly.

More than this, I think it guarantees, if any such were needed, that Floyd Abrams will go down in history as the greatest First Amendment champion of our era.

In part it has to do with the gentleman’s style.  Far from engaging the critics with language (like their own) that vilifies, Abrams flatters some of them for their scholarship.  Rather than retreat to the safety of quiescence or worse, he calls out even such as The New York Times, his client in the celebrated Pentagon Papers case.  And rather than indulge in any sort of self-pity, Abrams doesn’t even mention the scurrilous attack on him (because he wrote an amicus brief in opposition to McCain-Feingold) by Keith Olbermann, who predicted that Abrams “will go down in history as the Quisling of freedom of speech in this country.”

Summing up the essence of his argument, Abrams writes: “When I think of Citizens United, I think of Citizens United.  I think of the political documentary it produced, one designed to persuade the public to reject a candidate for the presidency.  And I ask myself a question: If that’s not what the First Amendment is about, what is?”

But enough of this.  Abrams’s piece is so powerful that nothing I say can embellish it.

The Financial Crisis and Horse Race Journalism

In 2001, the events of 9/11 were covered by the news media in a way that reassured and unified an angry and fearful country.  In 2008, a financial crisis that in its own way is as dire as 9/11 is being covered in ways that are divisive and infuriating.

At the root of the problem is the colossal failure of reporters to report the crisis, in the context of the presidential campaign, objectively and in a way that challenges the major party candidates to address the issue with the seriousness it demands.

Before it is over our financial and economic distress will almost certainly take the life savings and the livelihood of hundreds of thousands of people, and perhaps many more.  But by the evidence to date, reporters don’t get it.  So taken are they with the “horse race” conventions of political reporting that they have reduced even this, the worst economic portents since the Great Depression, to the familiar banalities of their stock in trade: who’s up, who’s down, and polls galore.

This, plus of course, their own political spin on things.  Thus are we told that the financial mess works to  Barack Obama’s political advantage …  and not much more.

Whether reporters perform this way because they are biased in favor of the Democratic Party and Democratic policies, or because they are themselves clueless about all things economic, or because they are, perforce, tethered to the inadequacies of the politicians they cover (with the correct answer being all of the above), makes not the tiniest bit of difference.

The stark fact is that the national news media have underreported and misreported virtually every important aspect of our national nightmare: how we got into it, how we can prevent it from happening again, and, most importantly, how we can escape its worst effects now — and how our national leaders can help us.  

Here at The Media Institute, which receives all of its financial support from media companies, we spend most of our time promoting the Speech Clause of the First Amendment.  This means that we promote those laws and regulations that maximize freedom of speech and of the press — something we will continue to do whatever the media’s journalistic shortcomings.

But at a time when all of the legacy media are in grave jeopardy — first from the competitive effects of the Internet, and now from the struggling economy — they are not making it any easier for themselves or for us.  If worse comes to worst, the people of this country are unlikely to forget or forgive the role the media have played at this crucial hour.

Conservatives and the Media

For maybe 50 years, self-described conservatives have been alienated from the dominant U.S. media — the Big Three TV networks, big-city newspapers, the national newsweeklies.  This alienation of a group that comprises as much as a third of the electorate has provided opportunities for such as talk radio companies, and the FOX News Channel, to pick up the pieces.

And even on the Internet conservatives are having success.  They may not have the political influence on the Republicans that the “netroots” have on the Democrats, but websites like the Drudge Report and Real Clear Politics are highly influential and display a clearly discernible right-of-center profile.

With this kind of success — owing entirely to the marketplace and deregulation — one would think that conservatives would be very chary about doing anything that might invite government control over media content.  And perhaps some are, but the loudest voices belong to those whose actions and agenda invite precisely this.

Take, for instance, the empire created by L. Brent Bozell.  From entertainment programming to journalism, the House that Brent Built gives voice to a brand of conservative criticism that spans issues from “broadcast indecency” to “liberal media bias.”

And if this were all that they did, there would be no qualms here about the Bozell-founded Parents Television Council (PTC) or his Media Research Center.  Media criticism, after all, is itself free speech.  But it isn’t all that they do.  Through organized letter writing campaigns, position papers, and filings at the FCC, the PTC actively encourages both legislative and regulatory action against “broadcast indecency.”

That this position contradicts one of the central tenets of modern conservatism — the imperative of limited government — is something that Bozell himself has acknowledged to be a conservative critique of his organization.  Alas, inconsistency (some would call it hypocrisy) of this sort does not weigh so heavily on the gentleman as to cause him to reconsider.

Like the late Reed Irvine, another conservative media critic who came before him, Bozell apparently believes that government regulation isn’t always a bad thing.  In Irvine’s case, the classic example of this was his support of the Fairness Doctrine.  Irvine believed that, without the Fairness Doctrine, conservatives would be bereft of any influence over the liberal sensibilities of broadcast journalists.  Of course we now know that repeal of the Fairness Doctrine led directly to the dominance in talk radio not of liberals but of conservatives!

In demonstration of the tenacity of history, this same Fairness Doctrine may yet prove to be Brent Bozell’s undoing too.  This, because these days all the talk, endorsed by such as the Speaker of the House, is of the reinstitution of the Fairness Doctrine.  Through the Media Research Center, Bozell is mobilizing his troops to fight against any such plan, but because of the pro-regulation stance of his PTC there are real questions about how much credibility his anti-Fairness Doctrine activities will have.

Oh, he will, one assumes, be able to organize a letter writing campaign, but such campaigns don’t equate  with credibility in the same way, and for the same reason, that power doesn’t equate with integrity.
